On May 9, 2024, the Philips Defendants and Plaintiffs’ Negotiating Counsel (“Parties”) entered into a Master Settlement Agreement (“MSA”) to resolve actual asserted claims or potential Personal Injury Claims against the Philips Defendants concerning certain recalled CPAP, BIPAP and ventilator products (“Recalled Devices”). This private Settlement Program is intended to resolve the claims of all United States Citizens or Residents who have a Qualifying Injury and who allege that they sustained such Qualifying Injury from (i) use of one or more of the Recalled Devices, and/or (ii) any asserted defects, delays or inadequacies relating to the Philips RS recall programs.
To participate in this private Settlement Program, Eligible Claimants represented by an attorney must have been: (1) included on an Identification Order Declaration of Primary Counsel and Eligible Claimant List with a Qualifying Injury on or before June 21, 2024; and (2) retained as a client by the attorney on or before April 29, 2024. For unrepresented or pro se Eligible Claimants to participate in the Settlement Program, they must have filed a Personal Injury Claim alleging a Qualifying Injury in the MDL Court or Massachusetts Court or submitted an Identification Order Declaration with a Qualifying Injury on or before June 21, 2024. See the definition of an “Eligible Claimant” on page 3 of the MSA.
To receive a payment from this private Settlement Program, all Eligible Claimants must submit a Registration Packet on or before December 10, 2024.
